Terms and Conditions

The terms that apply when you use this website or engage Thinking 4 Success for a project.
Last updated: 29 October 2026

In short: this website is for information. Every project we do is governed by a written quote or proposal that sets out the scope, price, timeline and payment terms. These terms fill in the general rules around that.

1. About us

As required by section 43 of the Electronic Communications and Transactions Act 25 of 2002 (ECTA):

  • Name and legal status: Thinking 4 Success (Pty) Ltd, a private company registered in South Africa
  • Registration number: 2014/113930/07
  • Director: Manesh Nagar
  • Physical address: 16 Kuneni Street, Winchester Hills, Johannesburg, 2091, South Africa
  • Email: manesh@4success.co.za
  • Phone / WhatsApp: 082 852 5017
  • Website: thinking4success.co.za
  • Self-regulatory bodies or codes of conduct: none

By using this website you agree to these terms. If you do not agree, please do not use the site.

2. Using this website

  • The content on this website is general information about our services. It is not advice, and it is not an offer that can be accepted without a written quote from us.
  • We work to keep the site accurate and available, but we do not guarantee that it is always error-free, complete or uninterrupted.
  • You agree not to misuse the site, for example by trying to gain unauthorised access, introducing malicious code, or using it for anything unlawful.

3. Intellectual property

The Thinking 4 Success name, logo, and the design and content of this website belong to us or our licensors. You may not copy or reuse them without our written permission. Client websites, names and images in our portfolio are shown as examples of our work and remain the property of their respective owners.

4. Consultations and quotes

  • Booking a consultation through this website does not commit you to anything.
  • Before any work starts, we provide a written quote or proposal. A project starts when you accept that quote and pay any deposit it requires.
  • The quote sets out the agreed scope, price, timeline, payment terms and number of revisions. If the quote and these terms conflict, the quote wins.
  • Work outside the agreed scope is quoted separately before we do it.

5. Your responsibilities as a client

  • Provide content, feedback and approvals on time. Delays on your side may move the project timeline.
  • Make sure you have the right to use any text, images, logos or other material you give us, and that it is lawful.
  • Keep your own copies of important content and data.
  • If your website collects personal information, you remain responsible for your own POPIA compliance and privacy policy. We can help you set this up.

6. Ownership of your website

Once your project has been paid in full, you own the content and design we created specifically for you, unless the quote says otherwise. Themes, plugins, fonts, stock images and other third-party components stay subject to their own licences. Some of these need annual renewal to keep receiving updates and security fixes. We may show completed projects in our portfolio unless you ask us not to.

7. Hosting, email and maintenance

Where we provide hosting, email hosting, maintenance or social media management, the fees, billing period and notice period are set out in your quote or service agreement. We rely on third-party infrastructure providers and cannot guarantee uninterrupted service. We will, however, act promptly to restore service and keep regular backups where hosting is included.

8. Electronic transactions and cooling-off

Where section 44 of ECTA applies to an agreement concluded electronically, you may cancel within seven days without reason or penalty. This right does not apply to services that have begun, with your consent, before the seven days end, or to the other exclusions listed in section 42 of ECTA.

9. Liability

To the extent the law allows, we are not liable for indirect or consequential loss, such as lost profit, revenue or data, arising from your use of this website or our services. Our total liability for any claim relating to a project is limited to the amount you paid us for that project. Nothing in these terms limits any rights you have under the Consumer Protection Act 68 of 2008, where it applies to you.

10. Links to other websites

This website links to third-party websites, including client sites in our portfolio. We do not control them and are not responsible for their content or practices.

11. Privacy and access to information

How we handle personal information is explained in our Privacy Policy. How to request access to our records is explained in our PAIA Manual.

12. Disputes and governing law

If something goes wrong, please contact us first and we will try to resolve it quickly and fairly. These terms are governed by the laws of the Republic of South Africa, and disputes fall under the jurisdiction of the South African courts.

13. Changes to these terms

We may update these terms from time to time. The version on this page, with its “last updated” date, applies from the date it is published. Changes do not affect quotes already accepted.
